iKhokha Referral Programme Terms

 

  1. Introduction

These iKhokha Referral Programme Terms (“Terms”) set out the requirements and conditions applicable to the Referral Programme.  By participating in the Referral Programme, you agree to be bound by these Terms. These Terms are published by iKhokha (“we”’, “us” and “our”) on our website. These Terms form a binding agreement for both the person who refer users, the referrer, (“you” or “your(s)”) and the person who receives our referral invitation (the “Referee”).

 

  1. How The Programme Works

  1. Refer a friend to sign up as a new merchant with us, and you can earn a cashback reward of R500.00 (five hundred rands) and additionally, the Referee will receive a 10% discount on the purchase price for the “iKFlyer Card Machine” if the following criteria ("Success Criteria”) is met: 

    1. The Referee must register with us and successfully fulfil the FICA (Financial Intelligence Centre Act) and onboarding requirements; 

    2. The Referee must process purchase transactions to a total value of at least R1000. Please note that the value of any purchase transactions subsequently refunded, will be deducted during the same month from the calculation of the total value of the purchase transactions for such month; and

    3. The Referee must be made through the referral link provided. 

 

  1. Issuing of Rewards and Discount Offers

  1. When the Success Criteria is met, your referral will be deemed a “Successful Referee”. As a result, you will receive the cashback reward in the month following the month in which the Success Criteria is met. Additionally, the Referee will receive a 10% discount on the purchase price of the iK Flyer Card Machine in the month following the month in which the Success Criteria is met. 

  2. We may verify the identity of both you and the Referee before granting the cashback reward and discount (if applicable).

 

  1. Privacy

  1. You may not share the Referee’s personal information with us without obtaining each Referee’s prior consent. 

  2. By participating in the Referral Programme, you warrant that you have obtained the Referee’s consent to share their personal information with us.

  3. You are responsible for ensuring that all personal information that is provided is accurate and up to date.

  4. By participating in the Referral Programme, you agree that we may collect and process the personal information received from you as part of this Referral Programme. The personal information will be processed in accordance with our Privacy Policy, available at https://www.ikhokha.com/terms-and-conditions-2021. 

  5. We may monitor your use of the Referral Programme.

 

  1.  Restrictions

  1. This Programme cannot be combined with our other programmes, discounts, vouchers, benefits or incentives. By participating in this Referral Programme, we may restrict you from any other promotion, programme, discount, and/or vouchers. This ensures that the Referral Programme operates independently and that the rewards earned through it are separate from other ongoing promotions.

  2. You must not engage in any fraudulent, deceptive, or unethical practices to generate referrals or engage in spamming, unauthorized advertising, or any other form of unsolicited communication in relation to the Referral Programme. 

  3. You must not publish our Referral Programme on any websites or platforms that promote adult content, gambling, games, online casinos, the sale of alcohol and tobacco and/or that displays political content. You may not engage in any form of illegal activities. This includes any other activities or content that may be deemed inappropriate or unlawful or may harm our reputation.

  4.  You must only use our Referral Programme for personal use and not for commercial purposes. 

  5. You may only invite personal friends, family members, acquaintances, and colleagues to this Referral Programme.

  6. If you are a current or former employee, contractor or affiliate of our company, you may not participate in the Referral Programme, and we may restrict or cancel your participation with immediate effect.

 

  1. Term and Termination

  1. This Referral Programme will run until the announced termination date, and that date can be extended in our sole discretion (the “Termination Date"). We reserve the right to terminate the Referral Programme with immediate effect. The Termination Date will be communicated on our website.

  2. If your referral was made before the Termination Date and meets the criteria of a Successful Referee, you will still be eligible to participate and receive the cashback reward. Additionally, the Refered individual will be eligible to receive a discount of 10 % off the purchase price of the IK Flyer Card Machine. However, we reserve the right to exclude referrals made after the Termination date at our discretion.

 

  1. Relationship

  1. You understand and agree that you are only a user of our services and/or products and you must refrain from implying any other affiliation, partnership, joint venture or legal relationship with us. 

  2. You understand and agree that you are never authorized to legally bind us. You are not authorized to enter into any agreements or commitments on our behalf.

  3. You must never create any materials that contain our branding, trademark, or any part of our corporate identity.

  4. When participating in the Referral Programme, you must represent yourself solely as an individual participant and not as a duplicate, agent, or intermediary of us.

 

  1. Amendments

We may amend these Terms from time to time. A copy of the latest Terms is available on our website.

 

  1. Breach 

  1. In case we suspect any violations of these terms or otherwise tampering with, fraud or unreasonable use of our Referral Programme, we may, in our sole discretion, cancel the distribution of the cashback payout and the applicable discount and you may be held liable for the loss incurred by us.  

  2. You must comply with all applicable laws and regulations and refrain from violating any third-party rights. These rights include any copyright, trademark and other proprietary rights.

 

  1. Disclaimer and Indemnification

  1. The cashback reward and discount are provided “as is” and cannot be exchanged for an alternative reward or discount. We may remove, change and update the Referral Programme in our sole discretion. Please refer to our website for the updated and latest Terms.  We will never make any promises or guarantees about the content and information of our Referral Programme. 

  2. By participating in our Referral Programme, you agree to defend, indemnify and hold us harmless from and against all claims, damages, liabilities, losses, expenses and costs (including reasonable attorney’s fees) arising out of your participation in the Referral Programme, including but not limited to any claims or damages resulting from sharing personal information in connection with the Referral Programme.

 

  1. No Correspondence, Disputes Refunds

We will not engage in any communication or address any complaints or disputes related to these Terms. Queries related to the cashback reward or discount can be referred to support@ikhokha.com.

  

  1. Governing law

The laws of South Africa shall govern any claim arising out of these Terms, and a competent court of South Africa shall have jurisdiction to hear such claims.

 

  1. Definitions

"IK Flyer Card Machine" refers to the portable card payment device provided by us for merchants to process transactions and accept card payments, the detailed specifications can be found on our website.
